Benjamin was born in 1692 in the Town of Southold, Suffolk County, Long Island, New York. N 1741, Benjamin married second Mehitable Homan in Southold. Benjamin made his will on 6 November 1774 at the Town of Southold.
In the name of God Amen I Benjamin Case of Southold in the County of Suffolk and Province of New York being weak in body but of sound mind and memory but calling to mind the uncertainty of this lie do make this my last will and testament in manner and form following viz first I gove and bequeath jnto my Endeared wife Mary my two fatting swine and one of my shoats to dispose of as she shall see fit also half the Grain growing on the ground also a Competency of my household Goods for to use so long as she remains my widow and no longer Item I give and bequeath unto my son Benjamin Case all my waring apparel Item I give bequeath and devise unto my two daughters Theodocia and Mary all the rest Residue and Remainder of my real estate and personal estate both in possession and reversion to be equally divided between them shear and shear alike and to their heirs and assigns forever Lastly I constitute ordain and appoint my Endeared wife Mary and my sons in law Abner Wells and Israel Reeve my Executors to this my last will and testament to see ye same performed according to my true intent and meaning - - In Witness whereof I have hereunto set my hand and seal this sixth day fo November and in ye year of our Lord Christ seventeen hundred and seventy four. Witnesses: Israel Reeve, P Wickham, Wiliam Case, Bejamin Davis.2
Benjamin departed this life on Monday, 14 November 1774 in the Town of Southold at age 82 years. His will was probated on 18 November 1774.
