John Malavery1

M, d. 1 November 1712
     John was born in Providence, Providence County, Rhode Island. John married Elizabeth Mowry, daughter of Roger Mowry and Mary Johnson, circa 1680 in Providence, Providence County, Rhode Island. A certain tract of land located in the far Northwestern part of Providence County, also the same corner of the state of Rhode Island, in a deed dated 16 May 1704, “ laid out unto the said John Inman” described in part as “some distance westward from that tract of land about Wesquadomesett belonging to Edward Inman & his partners & a little way distant from the now dwelling house of John Malavery . . . & adjoyneing to the Easterne part of Joseph Phillips his land, the said Phillips being son in law to John Malavery;” The next documented transaction dated 16 May 1704, “laid out unto Nathaniel Mawrey. . . adjoyneing to the Northerne side of the westerne part of the percell of land wheron the said Nathaniell Mawrey his son John Mawrey now dwelleth . . .not farr distant west Ward from the Tract of land lying Neare about the place called Wesquadomeset, the which belongth unto Edward Inman & his partners.” The partners of Edward Inman were his son-in-law, Nathaniel Mowery and Nathaniel’s brother, John Mowery. These family members, including John Malavery, were the founders of a settlement in this area known as Sayles Hill or Mowery Hill. John made his will on 24 July 1712 at Providence, Providence County, Rhode Island.

I Jon Malavery of Providence in the Colony of Roade Island in New England, being very weake of Body but of perfect sences and Memory, & calling to mind the Mortality of my Body, knowing it is apppoynted for all men once to dye; Therefore do make & Ordaine this my last Will & Testament; And as touching such Worldly Estate as it hath peased God to give unto me in this life, I give Demise & dispose of ye same in the following Manner and forme. - Imprimis: I Give to my well beloved son John Malavery all & singular my lands, meaddowes with all Rights of lands that belongeth to me with all the houseing to me at this time belongeth. - Item, I also Give and bequeath all my Moveabes, or Moveable Estate to my son John Malavery whome I make my true Executor of this my last Will & Testament; Except forty shillings in money which I Give & bequeath to my wel beloved daughter Elizabeth Phillips, and likewise to my other two daughters, Deliverance Mathuson & Mary Inman; - I Give & bequeath forty shillings to Each of them to be paid to them by my son John Malavery out of my Estate in Current money of New England; ffurthemore; If it so happen that I dye before my now wife Elziabeth Malavery, I order her to have a suteable & Convenient maintaineance out of this my Estate till shee departs out of this presant life; And so I make & ordaine my son John Malavery my true Executor of this my last will and Testament; And I do hereby disanull, Revoke & make voyd all other Testaments or Wills, Legacyes, Executors by me in aneys named; Ratifieing & Confirming this to be my last will & Testament: In Witness whereof, I have hereunto set my hand & seale this twenty fourth day of July in ye year of our Lord one Thousand seven hundred & twelve.
Signed Sealed & the mark of X John Malavery-Pronounced Published & Delcared by ye sd John Malavery Senr: to be his last Will & Testament, in the presence of us ye subscribers, Samuell Aldrich John Mawrey.2 John departed this life on Tuesday, 1 November 1712 in Providence, Providence County, Rhode Island. The inventory of John's estate was taken. It was taken by John Sayles and Richard Phillips. The value of the estate was £127 17s. 6p. His will was probated on 26 December 1712.
