Abigail (?)

F, b. 1755, d. May 1834
     Abigail was born in 1755 in Maryland. Abigail married 2nd Johan Andreas Heim, son of Johan David Heim and Maria Margareth, before 1805 in Maryland. Abigail's husband, Johan, died before 7 June 1819 in Buckeye Town District, leaving her a widow. Abigail made her will on 31 December 1831 at Frederick County, Maryland.

In the name of God, Amen, I Abigail Heimes of Frederick County, State of Maryland, being of Sound and disposing mind, memory and understanding and being anxious to settle my worldly affairs, before it should please God, to call me hence do make and constitute this my last Will and Testament that is to say First and principally I commit my soul into the hands of Almighty God, who gives it and my body to be decently buried by my Executor herein after named. It is my will that all my just debts and funeral charges be fully satisfied and paid by my Executor hereinafter named. Item. I bequeath the rest and residue of my Estate Real, personal, and mixed to be equally divided between the children and Grand children of my late husband Andrew Heimes, as follows to wit: David Heim, John Heim, George Heim, Andrew Heim, Mary Lambert, Barbara Boswell and the children of Elizabeth Ridgely, the children of Elizabeth Ridgely to have one seventh part of said Estate to be equally divided between them share and share alike. And lastly I constitute and appoint my Stepson Andrew Heim Executor of this my last Wil and Testament and revoke all other Wills by me hereuntofore made and declare this to be my last Will and Testament - In witness whereof I have herunto set my hand and affixed my Seal this thirty first day of December Eighteen hundred and thirty one -
Signed, Sealed, published and declared by the Testatrix, to be and contain her last Will and Testament, in presents of us the Subscribing, who, at her request and in her presents subscribed our names as witnesses[ thereto: Henry Nidorff, John Lugenbeel.

She wrote a codicil to her will on 21 November 1832. Whereas I Abigail Heim of Fredeick County have made and duly executed my last Will and Testament in writing bearing date the 31st of December 1831, which said Will and Testament and every clause, bequest and devise therein contained I do here by ratify and and confirm [Saving and excepting such clauses , bequests and devised therein mentioned as are by me hereafter revoked and made void] and being desirous to alter some parts thereof do therefore hereby make this my codicil which I Will and direct shall be taken and held as part of my said Will and Testament in manner and form following, that is to say. Whereas Andrew Heim in the Settlement of his Father's estate over paid George Heim, John Heim, and Elizabeth Ridgely and is likely to loose by them I therefore direct and devise, that part Andrew Heim & his heirs and assigns forever and that the said Andrew Heim, be entitled to four seventh parts instead of one seventh thereof as by my said former Will and do hereby revoke so much of my former will as gave the said George Heim, John Heim, & Elizabeth Ridgely children each one seventh part of my said Estate. In testimony thereof I have hereunto set my hand and affixed my Seal this twenty-first day of November one thousand eight hundred and thirty-two.

Signed, Sealed, published & declared by Abigail Heim the above named Testatrix, as & for a codicil to her last Will and Testament, in the presents of us who at her request and in her presents, and in the presents of each other have subscribed our names as witnesses there to: John Lugenbeel, Henry Nixdorff. Abigail departed this life in May 1834 in Frederick County, Maryland, at age 79 years. Her will was probated on 10 December 1834.

Maryland, Frederick County, To Wit - On the 31st day of May 1834, came Henry Nixdorff, and made oath on the Holy Evangely of Almighty God that the foregoing Instruments of Writing are are the true whole Will & Testament and Codicil of Abigail Himes, late of Frederick County deceased, that has come to his hands and possession, that he received the same from the Testatrix for safe keeping, and that he does not know of any other. Test G. W. Eichelberger Regr.
On the 10th day of December 1834, came Henry Nixdorff one of the subscribing witnesses to the foregoing last Will & Testament & Codicil of Abigail Heim, Dec'd, and made oath on the Holy Evangely of Almighty God, That he did see the Testatrix therein named Sign and Seal said Will & Codicil That they heard her publish, pronounce and declare former to be per last Will & Testament and the latter to be a Codicil to her said last Will & Testament. That at the times of her so doing, she was to the best his apprehension of sound & disposing mind, memory and understanding. That he subscribed his name as a witness thereto at the request of the Testatrix and in her presece and that he did also see John Lugenbeel, the other subscribing witness subscribe his name as a witness to said Will & Codicil at the request of the Testatrix and in her presence, and in the presence of each other -Test G.
