Mary Leggett

F, b. 25 September 1757, d. 21 September 1852
     Mary was born the 25th day of the 9th month 1757 in West Farms, Westchester County, New York. She was the daughter of Thomas Leggett and Mary Embree. Mary married James Barker on 11 February 1780 in New York. James and Mary had a son James [3/27/1782-12/01/1860]. Mary's husband, James, died either in 1785 or 1786 in Saratoga Township, leaving her a widow. Mary married 2nd Enoch Maxwell circa 1789 in Saratoga Township, Saratoga County, New York. Enoch and Mary had children: Anthony Leggett [1790-5/07/1863] [m. Rachel Stafford], Mary [1792] [m. Benjamin Lebaron], Embree [5/12/1793-6/25/1863], Euphemia [1794] [m. Josiah Dean], Abigail [6/01/1795-12/06/1846] [m. Darius Olney] & Martha [1796-2/13/1872] [m. David Olney]. Mary's husband, Enoch, died 14 May, either 1830 or 1831 in Saratoga Township, leaving her a widow. Mary made her will on 20 January 1850 at Saratoga Township, Saratoga County, New York.

Considering the uncertainty of this mortal life, and being of sound memory and mind, do make and publish this my last Will and Testament in manner and form following: - - - That is to say, I give unto my son Embree the farm I now live on, together with the personal property that I possess, by his paying the sum of five hundred dollars to my daughter Uphemia Dean, and thirteen hundred dollars to Mary Lebaron, by his paying the sum of Five hundred dollars to my daughter Upheimia Dean and thirteen hundred dollars to my daughter Mary Lebaron, by his paying the above legacies; that to Uphemia Dean is to be paid in one year after my decease, and the sum of thirteen hundred dollars to Mary Lebaron, to be paid her on completion of this my last Will and Testament. - - - I hereby appoint my son Embree Maxwell and John Garrison Executors of this my Last Will. In Witness whereof , I have hereunto set my hand and seal this twentieth day of January, in thee year of our Lord one thousand eight hundred and fifty. - - -Mary [her mark] Maxwell - - - Witnesses present Abraham Leggett & Ebenezer Leggett, both of the town of Stillwater.1

4 November 1850, Mary was listed on the U.S. Federal Census at Saratoga Township, Saratoga County, New York. Enumerated in this household were Embree Maxwell [54 New York], Mary [96 New York], Helen Adcock [15 New York], Thomas Aldrich [9 New York], Benjamin Labaron [43 New York], Mary Labaron [40 New York] & Patrick Raney [28 Ireland]. Embree and Benjamin & Patrick were farmers. The value of their farm was $3400.2 Mary departed this life on Tuesday, 21 September 1852 in Saratoga Township at her home at age 94 years, 11 months and 27 days. She was buried there in Quaker Springs Cemetery.3 Her will was probated on 11 April 1853. On this date, several of the children and grandchildren of Mary contested the will claiming she was not competent at the time she wrote the will. The surragate of the Saratoga County Court, on several different occasions, heard testamony concerning this issue. Finally on 24 December 1855, he proved the will as written and witnessed.
