     Phebe was born in 1832 at Independence Township, Oakland County, Michigan. She was the daughter of Aaron Beardslee and Sarah Fairchild. She married Archelaus Hibler on 9 July 1851 at Pontiac, Oakland County, Michigan. Phebe filed for divorce from Archilus Hibler on 5 May 1853 on the grounds of physical assaults and violence to herself. The acts being committed, due at least in part, to excessive consumption of alcohol. Testifying on her behalf was Sarah Thompson her mother and Orsamus Beardslee, her brother as well as others. Archilus denied all charges and acknowledged the presence of an eleven month old child of the marriage. No record was found of a disposition of this case. It was noted that Phebe was either living with her mother or brother at this time. It may be assumed that the divorce was not granted, for on 29 October 1856, Archilus Hibler petitioned for a divorce on the grounds of dissertion. The testimony at this hearing confirmed that Phebe had not resided with her husband since the last proceeding and in fact would not see him or speak to him. Archilus was granted his divorce 31 December, 1856. It should be noted that Phebe’s refusal to live with Mr Hibler was a result of her fear of her own safety and that of her child, when her husband became inebriated.1,2

For the past six months her husband has frequently and repeatedly assulted and beat her, knocked her down, kicked her and pulled her hair and about four weeks since choked her by clenching her by the throat so that she is afraid to live with him. During that time he has frequently been intoxicated by many ardent spirits. There is one child of this marriage who is now about eleven months old. …

    Witness for complainant: Sarah Thompson, resides in Independence and knows both of the parties. She is the mother of the complainant. Since the marriage, they have lived in their vicinity and she has lived with them a portion of the time. In May 1852 she lived with them seven or eight weeks or more at the time of the petitioner's confinement. The defendant was in the habit of using liquor and had ten gallons kept upstairs. Petitioner left the defendant about 1 Apr 1853 and came to the deponents house about a mile and % from the defendant's house on Saturday and returned to Hibler's on Monday. The deponent did not know the reason she left Saturday, but did learn it before she went back again. They lived with their little child who is 18 months old. The complainant said the defendant abused her and the child. Then she returned to the defendant, her mother went with her and the deponent followed within hearing distance of the house. The petitioner's mother went with her as she was afraid of the defendant who was in the habit of using ardent spirits. The deponent has seen the defendant drink but not so as to get into the gutter, but has seen him under the influence of liquor. Archelus' petition states that he is of Groveland Township, Oakland County and married at Orion Township, 9 Jul 1851, Phebe Ann Beardslee, now Phebe Ann Hibler and he continued to live with her as husband and wife until last of Mar 1853 at which time she deserted him at Orion and went to the house and home of her brother in Independence where she has remained ever since and now resides there. The petitioner states that he had provided a good home and abundance of necessities and conveniences of life and is still anxious that she should live with him as his lawful wife. Shortly after she deserted, the petitioner went to her brother's and asked to see her but she refused to come into his presence and refused to have any conversation with him. The petitioner is greatly injured in mind and estate by her desertion and he asks for a divorce.
